General information

Article 1. Offers/Agreements.

1.1 All offers of ‘Candle-Cover’ are without obligation and ‘Candle-Cover’ expressly reserves the right to change prices, specifications, texts and images, in particular when required by (legal) regulations.

1.2 An agreement is only established after acceptance of your order by ‘Candle-Cover’. Candle-Cover’ is entitled to refuse orders or to attach certain conditions to the delivery, unless expressly stated otherwise. If an order is not accepted, ‘Candle-Cover’ will communicate this within ten (10) working days after receipt of the order.

Article 2. Prices and payments

2.1 The prices stated for the products and services offered are in euros, including VAT and excluding any payment, handling and shipping costs, unless otherwise stated or agreed upon.

2.2 Payment shall be made in advance without discount or compensation unless otherwise agreed in writing.

2.3 Payment can be made in (one of) the way(s) as indicated during the ordering process.

2.4 If the prices for the products and services offered decrease in the period between the order and its execution, you can send us an email regarding the order. Primarily, a refund will be made for the amount of the price change in question or you may choose to cancel the order or rescind the agreement within (7) days of notification of the price change by ‘Candle-Cover’. This is at the discretion of the management of ‘Candle-Cover’. Any decision cannot be claimed by the customer.

2.5 Orders can only be cancelled within a period of 7 days after ordering (the so-called cooling off period) by means of a personal email to info@candle-cover.nl stating the order number and the customer details known to ‘Candle-Cover’. The cancellation of the order will then be processed by ‘Candle-Cover’ and you will receive a written confirmation (automated mail) of the cancellation.

2.6 If customer, hereinafter referred to as Client, has indicated that it wishes to use a bank transfer for payment of the order and payment for the order is not made, then Client is obliged and therefore responsible for payment of the outstanding invoice. Client will take care of the payment of the order, without ‘Candle-Cover’ having to take any action for this purpose. Candle-Cover’ will, if payment is not made within 7 days of the order, send a reminder to the Client. If the client fails to pay again, Candle-Cover shall be entitled to charge an administration fee of € 12.50. If payment of the order and administration fee is not made within 5 days after the reminder, ‘Candle-Cover’ will transfer the outstanding claim to a collection agency.

Article 3. Delivery

3.1 The delivery times given by ‘Candle-Cover’ are indicative only. Exceeding of any delivery period does not entitle you to compensation or the right to cancel your order or dissolve the agreement, unless the exceeding of the delivery period is such that you cannot reasonably be required to maintain the agreement. You are in that case entitled to cancel the order or dissolve the agreement to the extent necessary.

3.2 Cancellation of the order must be made by the client in writing. If ‘Candle-Cover’ has already incurred costs in connection with the order – for example transport costs and/or cash on delivery costs – these may be charged in full to the client. Cancellation shall be deemed to have occurred if the cash on delivery items are refused on the day of delivery without a legally valid reason.

Article 4. Intellectual and industrial property rights.

4.1 You must fully and unconditionally respect all intellectual and industrial property rights vested in the products delivered by ‘Candle-Cover’.

4.2 The intellectual property rights relating to this site belong to ‘Candle-Cover’ or its licensors. The user of this site is not permitted to copy, modify, sell, license, reproduce and/or disclose the content of the site, in whole or in part, without the express written permission of ‘Candle-Cover’.

Article 5. Complaints and liability

5.1 You have the obligation, upon aflivery, to examine whether, in your opinion, the products comply with the agreement. If this is not the case, you must inform ‘Candle-Cover’ as soon as possible and in any case within seven (7) working days after the aflevering, or at least after observation was reasonably possible, in writing and with reasons.

5.2 If it is demonstrated that the products do not comply with the agreement, ‘Candle-Cover’ has the choice of replacing the products in question with new products upon return or refunding the invoice value thereof.

5.3 If you do not wish to take delivery of a product for any reason, you have the right to return the product to ‘Candle-Cover’ within fourteen (14) working days of aflivery. Returns in this case will only be accepted if the packaging of the product is undamaged, where also applies that the costs for returning the product are for your account.

Article 6. Force Majeure

6.1 Without prejudice to its other rights, ‘Candle-Cover’ has the right in case of force majeure, at its option, to suspend the execution of your order, or to dissolve the agreement without judicial intervention, by notifying you in writing and without ‘Candle-Cover’ being liable for any compensation, unless in the circumstances this would be unacceptable according to standards of reasonableness and fairness.

6.2 Force majeure means any failure which cannot be attributed to ‘Candle-Cover’ because it is not due to its fault and is not for its account under the law, legal act or generally accepted practice.

Article 7. Miscellaneous

7.1 If one or more of the provisions of these terms and conditions or any other agreement with ‘Candle-Cover’ should be in conflict with any applicable legal provision, the provision in question will lapse and will be replaced by a new comparable provision to be determined by ‘Candle-Cover’.

7.2 ‘Candle-Cover’ is authorized to use third parties in the execution of your order(s).

7.3 The Terms shall remain in effect in the event that “Candle-Cover” changes all or part of its name, legal form or ownership.

7.4 Should ‘Candle-Cover’ transfer an agreement entered into with a client to a third party, the client already consents to this in advance.

Article 8. Applicable law and competent court

8.1 All rights, obligations, offers, orders and agreements to which these Conditions apply, as well as these Conditions, are exclusively governed by Dutch law.

Privacy
‘Candle-Cover’ takes your privacy very seriously. The confidentiality and protection of your personal data are a matter of course for us. We appreciate the trust you place in us and will take the utmost care to protect your data to the best of our ability. We treat your personal data strictly confidential. We will never sell, rent or pass on your e-mail address, your name or other personal data to third parties, with the exception of third parties engaged in the execution of your order. The data you enter when creating an account will only be used by us for handling your orders and for offers regarding our website.

Use of Cookies
‘Candle-Cover’, in offering its services, uses cookies to identificate you and thus make access to the site easier for you. A cookie is a simple small file stored on your computer’s hard drive. You can disable the acceptance of cookies in your browser. A user of this Internet service who does not accept cookies from the www.candle-cover.nl domain will have limited access to this site. ‘Candle-Cover’ does not use the information from cookies on an individual level.

Disclaimer
Any information, services or products found on this website may contain errors and may be subject to temporary interruption. Although ‘Candle-Cover’ does its utmost to provide all information, services and products as good and flawless as possible, it cannot be held responsible for any errors, defects, lost income or other damaging consequences, resulting from the use of this website. ‘Candle-Cover’ waives any liability whatsoever, within the limits of Dutch law.

Returns
Items that are not damaged can be returned within 14 days of receipt. The purchase amount, after providing the IBAN account number, will be refunded within 14 days upon receipt of the returned item.

The cost of return shipping is at the buyer’s expense. Returns are at the buyer’s risk. This means that Candle-Cover is not liable for damaged or lost returned items. Therefore, always ask for a tracking code at the post office and keep it safe.

The following procedure applies to the return of products:

1.You submit a request, within your account at ‘Candle-Cover’ and for this purpose fill in the electronic form with the data that are important for us regarding the ability to process the return request;

2.You will receive from ‘Candle-Cover’ a written confirmation (automated email) of your request;

3.You must enclose the return slip or the information listed on it with the product in the package or it will be clearly marked on the package;

4. Upon receipt, we will replace the product or refund the (partial) amount of the order in accordance with our General Terms and Conditions;

5.You are responsible for your own return shipping and handling unless otherwise agreed.

6.Packages without a return slip or indication of the necessary data cannot be processed and will unfortunately be refused; All our deliveries are subject to these general terms and conditions.

Conditions
– You return the item within the 14-day trial period. The period starts the day after receiving your item.
– The item is, if reasonably possible, in its original packaging.
– We would like to ask you, if possible, to include the invoice (or a copy of that invoice) in the package.
– For quick and proper handling, it is important that you first report the item return via email: info@candle-cover.nl

Candle-Cover processes your personal data for the following purposes:

– Sending our newsletter and/or advertising folder
– To be able to call or e-mail you if this is necessary to be able to carry out our services

View, correct or delete data
You have the right to view, correct or delete your personal data. You can do this yourself via the personal settings of your account. This means that you can submit a request to us to send the personal data that we hold about you in a computer file to you or another organization named by you.

To make sure that the request for inspection is made by you, we ask you to send a copy of your ID with the request. In this copy, black out your passport photo, MRZ (machine readable zone, the strip of numbers at the bottom of the passport), passport number and Citizen Service Number (BSN). This is to protect your privacy. Candle-Cover will respond to your request as soon as possible, but at least within four weeks.

Candle-Cover takes the protection of your data seriously and takes appropriate measures to prevent abuse, loss, unauthorized access, unwanted disclosure and unauthorized modification.
